Copyright and Takedowns

If something of yours is on WikiDerby and shouldn't be, tell us and we will take it down. Here is how to do that, and what happens next.
What is actually hosted here
Most of what you see in a race is Wikipedia, loaded live from Wikipedia and not stored by us. Background images come from Wikimedia Commons and carry their author, licence and a link back, because those licences require credit and we would rather give it properly than argue about it. If a Commons image is on Commons wrongly, the fix belongs on Commons — although tell us anyway and we will stop showing it.
The part that is genuinely ours to police is what players make and upload: cursors and trails drawn in the maker, images set as themes, profile pictures, player names and chat. That is what this page is for.
Sending a takedown notice
Email support@xofanic.com with the subject line Copyright notice. To be effective under the DMCA a notice has to include all six of these, so please don't leave any out:
- Your physical or electronic signature.
- What work you say is infringed. If it is several, a representative list is fine.
- Where it is on WikiDerby, precisely enough for us to find it — the item name, the player wearing it, a screenshot, a link. "Somewhere in the shop" is not enough and will only slow this down.
- How we can reach you: address, telephone number, email.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the owner or authorised to act for them.
You do not need a lawyer or a template service to do this. A clear email containing those six things is a valid notice.
Our designated agent
Email support@xofanic.com. It is read by a person and it is the fastest way to reach us. A formal designated agent is being registered with the U.S. Copyright Office and this page will name them here once that is done; in the meantime a notice sent to that address is received and acted on exactly as described below.
What we do about it
We aim to look at every notice within a few days — realistically much sooner, because this is a small game and the mailbox is not busy. If the claim is clear we remove or disable the material straight away and tell whoever posted it what was removed and why. We would rather take something down and discuss it afterwards than leave it up while we deliberate.
If we took down something of yours
You can object. Email support@xofanic.com with a counter-notice containing:
- Your signature.
- What was removed and where it used to be.
- A statement under penalty of perjury that you believe in good faith it was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of a US federal court for your district — or, if you are outside the US, any district where we may be found — and that you will accept service from the person who sent the original notice.
We pass a valid counter-notice to whoever complained. If they do not go to court within 10–14 business days, the material can go back up. Be aware that a counter-notice gives your contact details to the complainant, which is a real consequence and worth knowing before you send one.
Repeat infringers
Accounts that repeatedly infringe are terminated. This is not a formality we have written down and ignored: bans are enforced by account and by address, and an account terminated this way does not get to come back under a new name. Uploaded items are removed with it.
Please don't misuse this
Knowingly filing a false takedown notice — or a false counter-notice — carries liability for damages and legal costs under the DMCA. If you are not sure whether you own something, say so in the email and we will work it out with you rather than holding you to a statement you should not have made.
